- Additional contracted hours charged in minimum of one hourly blocks at $85/hr.
- Copywriting is charged in minimum of one hourly blocks.
- Stock images are not included.
- Stock image sourcing/management is charged in minimum one hourly blocks.
- Stock image costs are passed directly onto the client. - Photography is not included in this quote, although Smart Artz can supply a preferred professional Photographer.
- Artwork files are only production ready files & are not supplied or transferred in full to the client. File release payment is required for full transfer of files to the client.
- Logo design packages include two design development stages, additional design development stages charged in hourly blocks $85.00 per hour.
TERMS OF PAYMENT
Smart Artz requires 50% deposit required after quote approval to allow work to commence. The remaining full payment is required on delivery of completed product or design. Smart Artz requires full payment of logo & corporate identity packs within one month of the customer’s project approval or design work order. Upon receipt of final payments, all rights to all material goods/ products, logos & design, will be released to the customer for use in all media & in all markets, for unlimited period of time. Business card, letterhead & with compliments slip working files are not transferred up completion of logo design packs, transfer fee applies to these files upon request
OWNERSHIP
Smart Artz agrees to sign over all rights associated with ownership & usage of materials developed by Smart Artz to the customer upon receipt of final & full payment for the outlined materials. Until that time Smart Artz retains & reserves all rights to all/any content created by Smart Artz.
Hourly design fee does not constitute full ownership for design material. Full ownership of design templates are transferred only upon full payment for the design/template not an hourly design fee. Logo & corporate identity packs constitutes full payment & ownership of logos. Smart Artz retains & reserves the rights to use any & all content developed by Smart Artz, regardless of ownership, for display & self-promotional purposes.
TRADEMARK & COPYRIGHT
Smart Artz provides no guarantee of copyright to the customer. The customer assumes responsibility for obtaining Trademark or Copyright for any material created by Smart Artz. Smart Artz assumes no liability in the event that a customer is unable to obtain Trademark or Copyright for the given material for any reason. Other information may be requested by Smart Artz & every effort is made to ensure that the client specifications are adhered to. No responsibility is taken by Smart Artz for approved works deemed to be faulty upon reception after printing. All care & due diligence is taken to ensure that printed, finished products & documents are error free, but completion signature indemnifies both Smart Artz & the material goods supplier from liability. Proofs may be submitted in Hard Copy & electronically & all documented emails from the client will be accepted as consent & authorization. Electronically submitted proofs may be of lesser quality than final printed goods in order to reduce file size. These terms & conditions pertaining to the order & authorization of work may be amended & corrected with notice to the client in writing. All care is to be assumed by the client to provide proper & reasonable notice of work.
No responsibility is taken by Smart Artz for delays & errors as a result of 2nd & 3rd party contractors including photographers, distributors, material goods suppliers, talent etc.
